Persuader Watch for July 7, 2025

Recent filings with the Department of Labor’s Office of Labor-Management Standards (OLMS) reveal that several companies have engaged “persuader” consultants. These filings, known as LM-20 forms, are required when employers hire outside consultants to persuade employees regarding their rights to organize and bargain collectively.

  • Tootsie’s Entertainment LLC, a Nashville, Tennessee-based company located at 422 Broadway, has engaged Government Resources Consultants of America Inc. The agreement was dated May 28, 2025 and the NLRB status for case 10-RC-365430 is currently closed and withdrawn.

  • NASCO, operating from 3600 E. 95th Street in Chicago, Illinois, has enlisted CACR Labor Education Services for persuader services. This agreement, dated May 28, 2025, came with a compensation rate of $350 per hour and targeted workers organizing with the International Union of Operating Engineers (IUOE) Local 150.

  • Ocean State Job Lot of North Kingstown, Rhode Island, located at 375 Commerce Park Rd, has retained East Coast Labor Relations, LLC. This agreement, dated June 1, 2025, carries a compensation rate of $3800 per day and involves workers and the International Brotherhood of Teamsters (IBT) Local 251. The NLRB case 01-RC-366017 is currently open.

The filing of LM-20 forms provides transparency into employer-consultant agreements aimed at influencing employees’ decisions regarding union representation. The U.S. Department of Labor mandates these disclosures to ensure workers are aware when outside parties are involved in their workplace’s labor discussions. Unfortunately, the labor relations industry’s compliance with these transparency rules is low and enforcement needs significant improvement.
